How is your company managing unclaimed property, the risk of an audit, and the likelihood of decades of potential financial exposure? Recent developments in unclaimed property law and renewed initiatives by state auditors to enforce compliance have created the very real potential of protracted audits resulting in extensive liabilities for businesses that have either unintentionally ignored or misunderstood their reporting responsibilities under current law.
Unclaimed Property includes, but is not limited to, unclaimed stock, abandoned bank accounts, credit account receivable balances and uncashed checks (vendor, payroll, dividends, etc.). ALL companies have an unclaimed property liability, and compliance with state law is mandatory. Many states have no statutory provision to allow for a “statute of limitations” on property that has not been properly reported, potentially resulting in audits going back 15-20 years. In addition, state authorized auditors may use estimation techniques to determine liability, thereby increasing your company’s risk exposure.
Join us in a discussion on the basics and background on the purpose and requirements of unclaimed property law; the greatest potential areas of risk for a company and the enforcement efforts being utilized by states. See firsthand how unclaimed property noncompliance may also result in violations of federally imposed internal control requirements and financial reporting procedures under Sarbanes-Oxley.
